Despite dubious claims to the contrary, Israel has international law on its side.

Contrary to claims made by Palestinian leadership and others in the international community, international law fully recognizes Jewish claims in Judea and Samaria. These areas were part of the Palestine Mandate, which granted Jews the right to settle anywhere west of the Jordan River and to establish a national home there.

History reminds us that the Palestine Mandate, supported by all 51 members of the League of Nations at the time, and codified in international law, is recognized as legally valid by the United Nations in Article 80 of the UN Charter. In addition, the International Court of Justice has reaffirmed this on three different occasions.

While some people argue that the Palestine Mandate became obsolete following its termination in 1947, international legal scholars claim otherwise. According to Eugene Rostow, a Dean of Yale Law School, “A trust never terminates when a trustee dies, resigns, embezzles the trust property, or is dismissed. The authority responsible for the trust appoints a new trustee, or otherwise arranges for the fulfillment of its purpose.” While the Palestine Mandate ceased to exist in Israel and Jordan when Israel and the Hashemite Kingdom obtained independence, Rostow maintains that “its rules apply still to the West Bank and the Gaza Strip, which have not yet been allocated either to Israel or to Jordan or become an independent state.”

This international law expert adds that the Armistice Lines of 1949, which are part of the West Bank boundary, “represent nothing but the position of the contending armies when the final cease-fire was achieved in the War of Independence. The Armistice Agreements specifically provide, except in the case of Lebanon, that the demarcation lines can be changed by agreement when the parties move from armistice to peace.” Simply put, international law does not consider the 1967 borders the internationally recognized borders of the State of Israel.

Israeli legal claims to Judea and Samaria are strengthened by the fact that no other sovereign nation state claims this territory as her own. Both the Ottoman Turks and the British Mandate renounced their claims to the Land of Israel decades ago, including Judea and Samaria. Furthermore, Jordan’s annexation of Judea and Samaria following Israel’s declaration of independence was never internationally recognized, since it amounted to an act of aggression. Both the UN Security Council and UN General Assembly declared at that time that Israel was a peace-loving state in the 1948 war.

Professor and Judge Stephen M. Schwebel, who served as President of the International Court of Justice, explains that the principle of “acquisition of territory by war is inadmissible” must be read together with other principles, “namely, that no legal right shall spring from a wrong, and the Charter principle that the Members of the United Nations shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any State.” In other words, territories acquired through wars of aggression don’t hold validity, which effectively repudiates Jordanian claims to Judea and Samaria. Observers argue too that the fact that Jordan has officially renounced her claims to Judea and Samaria and signed a peace agreement with Israel without gaining back these territories seals the water-tight case for Israel’s jurisdiction there.

The situation, however, is different when a country reclaims lands that originally belonged to her as part of a war of self-defense, as Israel did in 1967. “Where the prior holder of territory had seized that territory unlawfully, the state which subsequently takes that territory in the lawful exercise of self-defense has, against that prior holder, better title,” adds Professor Schwebel.  ”Between Israel acting defensively in 1948 and 1967 on the one hand, and her Arab neighbors acting aggressively in 1948 and 1967 on the other, Israel has the better title in the territory of what was Palestine, including the whole of Jerusalem, than do Jordan and Egypt.”

Feiglin: No "Palestinian Nation"



Likud MK says Israel is losing its own legitimacy by acknowledging “Palestinian” rights to the Jews' land.

As “peace talks” between Israel and the Palestinian Authority are set to restart, MK Moshe Feiglin (Likud) says it is the proponents of the supposedly pragmatic “two state solution” who are the truly delusional ones.

“The very recognition that there is a 'Palestinian nation' that has rights in our country's heartland is a tragedy in and of itself,” Feiglin wrote Sunday.

“When you recognize that a different nation has rights in your land, you lose your own legitimacy. When you surrender your sovereignty on the Temple Mount to the Muslim wakf and then you do not build at all in Jerusalem, which is what is happening now, you lose your legitimacy in Sderot, Tel Aviv and Holon.

In universities in London and Paris they are already explaining that there is no legitimacy for a Jewish state anywhere in the world. That is the result of these rounds of talks.

“Heel vervelend”, noemt woordvoerder Anneke van Kempen van Hoogvliet het op Distrifood.nl. Ze legt het misverstand graag uit. “Dagblad Trouw heeft ons antwoord op hun vraag over de verkoop van producten uit de bezette gebieden in Israël volkomen verdraaid. Op de vraag of wij producten uit de 'bezette' gebieden (die niet bezet zijn) verkopen, hebben wij geantwoord: nee, wij verkopen geen producten uit die regio.” Boycot is de term die Trouw gaf aan ons antwoord, benadrukt Van Kempen. “Wij betreuren dat hierdoor de indruk is gewekt dat wij als supermarkt politiek bedrijven.”

Ook Jumbo Supermarkten hekelt de berichtgeving in het landelijke dagblad, waarin het beeld dat de supermarktketen producten uit de Joodse nederzettingen boycot. “Dit is niet het geval”, zegt een woordvoerster.Bij het inkoopbeleid van Jumbo’s huismerk gaat het om: kwaliteit, prijs, beschikbaarheid en internationale inkoopvoorwaarden. “Net als bij veel andere retailers. De voorwaarden staan los van het land van herkomst.”

Omdat een boycot een politieke keuze zou zijn, neemt Jumbo hierin geen stelling, legt de zegsvrouw uit. Overigens voert het familiebedrijf momenteel geen producten uit door Israël bezet gebied in zijn assortiment. “Maar voldoen ze aan alle inkoopvoorwaarden dan komen ze hiervoor wel in aanmerking.”

Nazi hunting campaign kicks off in Germany

The Simon Wiesenthal Center is seeking information on Holocaust perpetrators still at large.

The posters depict an ominous photograph of the Auschwitz-Birkenau Nazi-run death camp, with a tagline that reads: Late, but not too late.

Millions of innocents were murdered by Nazi war criminals. Some of the perpetrators are free and alive, the posters continue. Help us to bring them before a court.

One former war criminal, Ivan Demjanjuk, was convicted as late as 2011. Demjanjuk was a concentration camp survivor found guilty of complicity in some 30,000 Jewish deaths in German-occupied Poland during World War II. He is being cited as an example by the center as a reason for people not to rest on their laurels when it comes to catching remaining war criminals.

This conviction paves the way for additional prosecutions of individuals who served in death camps, as well as the members of the Einsatzgruppen [mobile killing units], stated the center's chief Nazi-hunter and Israel director Dr. Efraim Zuroff.

The Simon Wiesenthal Center is dismissive of anyone who questions the value of bringing elderly war criminals to justice, listing five points for the apprehensive observer to take into consideration, two of which are: The passage of time in no way diminishes the guilt of the killers, and old age should not afford immunity to murderers.

Zuroff is adamant that remaining Nazi war criminals should be made to face up to their actions regardless of the passage of decades since the close of World War II.

In my 33 years of hunting Nazis I never once had a case of a Nazi who ever said he was sorry, Zuroff told AFP. These are the last people on Earth deserving any sympathy because they had absolutely no sympathy for their victims.

Two cases earlier this year saw two men in their 90s charged with their role in enabling mass atrocities to take place. In June, Laszlo Lajos Csatari, 98, was charged in Hungary with organizing the deportation of some 12,000 Jews to death camps while a former Auschwitz guard named Hans Lipschis, 93, was arrested in Germany under suspicion of complicity in mass murder.

Aldi noemt boycot Joodse nederzettingen vergissing



Aldi Nederland heeft zijn uitlatingen over een boycot van producten uit Joodse nederzettingen teruggetrokken. Dat schrijft Trouw dinsdag.

Maandag maakten supermarktketens Aldi en Hoogvliet, gevestigd in de Randstad en de regio Utrecht, bekend geen producten meer te verkopen die afkomstig zijn uit Joodse nederzettingen in 'Palestijns' gebied (betwiste gebieden).

Aldi zei maandag tegenover Trouw dat zij niet wil dat de producten 'op enigerlei wijze ter discussie komen te staan' en eiste daarom van de leveranciers dat zij niets leveren uit 'bezet' gebied (=leugen).

De krant had vragen gesteld over uitspraken van Aldi in een rapport van hulporganisaties, waarin een medewerker van de supermarkt stelde dat men 'geen producten uit Israëlische nederzettingen in de bezette gebieden meer wil verkopen'. Trouw vroeg vrijdag aan de supermarkt of de beweringen kloppen, daarop antwoordde Aldi volgens de krant bevestigend.

Gisteravond heeft Aldi deze uitspraken teruggetrokken. Er zou bij het beantwoorden van de vraag een vergissing zijn gemaakt. De krant vermoedt dat Aldi vooral geschrokken is door de internationale commotie die is ontstaan.

Nu is het zo, dat ik heel graag Israëlische kwaliteitsproducten aanschaf en wil kopen. Daarvoor kan ik nu niet meer bij uw winkelketen terecht. Dat zou dus betekenen voor mij en andere kennissen die ik heb, dat wij bij uw winkels geen boodschappen meer gaan doen, dus uw supermarkt boycotten. Dat is het gevolg van uw ondoordachte en onterechte beslissing om mee te doen aan deze pro Palestijnse actie. De Aldi heeft inmiddels al besloten hieraan niet meer deel te nemen, en we zijn blij dat de Aldi hun fout toegeeft. Hopelijk stopt u ook met deze onzinnige en vernederende actie."

IDF Haredim soldiers build new Electronic Warfare System



Ultra-Orthodox soldiers serving in the army’s Computer Services Directorate have recently completed development of an advanced electronic warfare system, which significantly improves the operational abilities of forces along the nothern and Gaza borders.

Far from the limelight, haredi soldiers serving in the army are racking up impressive accomplishments. The secret system provides an operational solution to a gap which existed within the army in terms of daily security.

Among others who received compliments on the system’s success from senior army officials were the soldiers are behind its development –haredi software developers from a special program for the integration of haredim into the army, who after many months of work, succeeded in implementing the innovative system and proving its effectiveness.

“We could have taken this to a civilian company which is an expert in the field, but we preferred to leave it in the army and allow the team with the haredi soldiers to develop the system,” said a senior official in the Directorate.”They succeeded and even earned much recognition. Additionally, their success within the IDF saved us millions of shekels.”

Syrian rebels claim Israel Air Force took out Assad’s S-300 battery



The Free Syrian Army claimed Monday that the Israel Air Force had destroyed a warehouse holding Russian S-300 anti-aircraft missiles east of the city of Homs in western Syria. The rebels’ claim has not been corroborated by any other independent source.

In a Facebook post titled “The new Israeli strike,” the rebels alleged that “the brave Syrian regime has conceded that a new Israeli strike targeted a warehouse containing Russian S-300 missiles and launchers. The facility was located in the al-Qassia camp, near the town of al-Hafa, east of Homs.”

The post further insinuated that the attack was meant to stop the Free Syrian Army from seizing the advanced weapons system.

Another report, by Syria’s al-Haqiqa news website, claimed that “a senior Israeli official” confirmed that the explosion that destroyed an arms depot in the port city of Latakia last week was not the work of al-Qaida, as the state-run Syrian media reported, but yet another Israeli attack.

According to the report, the explosion destroyed a Syrian navy weapons depository holding Russian-made Yakhont anti-ship cruise missiles. The website quoted the official as allegedly saying he could “neither confirm nor deny,” whether the Israeli military was responsible for the attack.

Israel to Obama: Stop being so naive on Egypt



A senior Israeli government official on Tuesday said US President Barack Obama must stop being so naive on Egypt, and should avoid the same kind of failed policies Washington implemented during the last Egyptian revolution.


Like most Egyptians today, Israel largely blames Obama for facilitating the hijacking of the 2011 revolution by the Muslim Brotherhood.

It was Obama's "naivete" that led him to engage with the Muslim Brotherhood as former Egyptian President Hosni Mubarak was being ousted, the Israeli official told Israel Radio. And it was that American engagement that provided the Muslim Brotherhood with the legitimacy it needed to seize power.

The current situation in Egypt is likely to be protracted, as the Muslim Brotherhood is not expected to give up power without a fight. If the military is to maintain order and prevent a relapse to Islamist rule, it will need international support, and a continuation of American financial aid.

Israel is lobbying Washington to maintain aid to the Egyptian army, even though American law mandates freezing the transfer of funds if it is determined that a military coup has occurred.

Koning en Koningin bezoeken Joodse Gemeente Amsterdam



Zijne Majesteit Koning Willem-Alexander en Hare Majesteit Koningin Máxima hebben vanmiddag een bezoek gebracht aan de Joodse Gemeente Amsterdam (NIHS).

De Koning en Koningin werden rondgeleid door de synagoge aan het Jacob Obrechtplein en spraken met vertegenwoordigers van verschillende organisaties binnen de joodse gemeente in Amsterdam.

De Joodse Gemeente Amsterdam bestaat 375 jaar en is een bloeiende gemeente met vele activiteiten. Vanuit de gemeente worden onder meer diensten in vijf synagogen georganiseerd, joods onderwijs verzorgd en sociaal en cultureel werk verricht.

Na een korte toelichting op de geschiedenis van de Nederlands Israëlitische Hoofdsynagoge (NIHS) en uitleg over het interieur en geschiedenis van de synagoge, ontmoetten de Koning en Koningin vertegenwoordigers van joodse organisaties. Zij spraken onder meer met studenten, scholieren en leerkrachten van joodse scholen, met vertegenwoordigers van Maccabi-sportverenigingen en de beveiligingsorganisatie “Bij leven en welzijn”.

Het bezoek werd afgesloten met een gelegenheidsgebed en een zegening door opperrabbijn Aryeh Ralbag, zoals deze ook wekelijks in de dienst wordt uitgesproken voor het Koninklijk Huis.

NIK-rabbijn R. Evers gaf de koning en de koningin een toelichting bij het synagoge-bezoek.

More then nine million people speak Hebrew



The Hebrew language is difficult, and yet - nine million people speak Hebrew in the world, according to figures currently published by the Central Bureau of Statistics.

According to a report in Israel Today, over a million and a half Israelis living in Israel do not speak Hebrew language as a first language and have trouble with it.

29% of immigrants from the Soviet Union who arrived in Israel after 1990 and do not speak Hebrew optimally, prefer to avoid approaching government services due to language difficulties. Language problems also affect employment status, more than half of the population believes that knowledge of Hebrew "greatly affects" the chances of finding employment.

Another part of the survey examined the attitude of Israelis to Arabic, which is considered a second language in the country: 70% agree that it is very important that all government forms will be in two languages, but only 29% believe that it is important that all Israelis know Arabic. Among Arabs there is an evident desire that all citizens will speak their language: 68% believe that it is "important" or "very important" that schools in the Jewish sector would learn Arabic as mandatory.

Prime Minister Benjamin Netanyahu on Tuesday reminded the world of the IDF’s capabilities, speaking during a Knesset ceremony marking the 37-year anniversary of Operation Yonatan, the raid on Uganda’s Entebbe airport to free over 100 passengers held hostage after a terrorist hijacking.

“The threats upon us for the past 37 years continue,” said Netanyahu. “But the example of Entebbe shows we can overcome them, and today, too, I say that there is no place that the IDF’s long arm will not reach in order to defend the state of Israel.”

The ceremony was initiated by MK Omer Bar-Lev (Labor), who participated in the Entebbe rescue.

A week after Palestinian and German terrorists hijacked an Air France flight from Tel Aviv, forcing it to land in Uganda, commandos from the elite Sayeret Matkal unit shocked the world by flying to Entebbe Airport on July 4, 1976, and rescuing the passengers.

Netanyahu’s brother Yonatan commanded the operation, and was the only IDF casualty. The raid was named after him posthumously.

MK Shelly Yachimovich (Labor), leader of the opposition, responded to Netanyahu’s statement by urging him to take steps toward a peace agreement. “The decisions that must be taken by a leader are not the same in every generation,” she told him after praising the Entebbe operation. “The long and alert arm needs to be extended for missions of peace as well.

“Just as bravery is demanded in the war on terror, bravery, daring, wisdom and cohesion are demanded in order to ensure our existence here as a strong and just Jewish democratic state,” she said. “Go with bravery and ferocity to a comprehensive process that will ensure the continuation of the state of Israel as a Jewish democratic state.”
